1. Scope of Services
ComplyQuick operates as an intermediary platform that facilitates digital signature certificate services. Our role is specifically limited to:
1.1 Primary Services
- Consultation Services: Assisting users in selecting the appropriate Digital Signature Certificate (DSC) type based on their requirements
- Application Processing: Acting as an intermediary to process applications to authorized Certifying Authorities (CAs) including eMudhra, Vsign, Pantasign, and Capricorn
- Document Management: Facilitating the collection, verification, and submission of Know Your Customer (KYC) documents as required by CAs
- Payment Processing: Enabling secure digital payments through authorized payment gateways
- Customer Support: Providing guidance throughout the DSC application process
1.2 Important Clarifications
- We are NOT a Certifying Authority (CA) and do not issue Digital Signature Certificates ourselves
- Final authority for DSC approval lies solely with the respective Certifying Authority
- We act as facilitators and intermediaries only, with no authority over the final decision-making process of CAs
- All DSCs are issued directly by the respective CAs in accordance with their terms and conditions
2. Legal Framework and Compliance
These Terms are drafted in accordance with and governed by the following Indian laws and regulations:

- Information Technology Act, 2000: Provides the legal framework for digital signatures in India and ensures security and authenticity of documents filed electronically
- Consumer Protection Act, 2019: Ensures transparency and accountability in digital services and addresses unique challenges faced by online consumers
- Indian Contract Act, 1872: Governs contractual obligations and enforceability of digital agreements
- Competition Act, 2002: Prohibits anti-competitive practices and ensures fair market practices
2.2 Regulatory Guidelines
- Reserve Bank of India (RBI) Guidelines: Applicable to online payment processing and electronic transaction security
- Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021: Governing intermediary liability and due diligence requirements
3. Regulatory Compliance and Oversight
ComplyQuick operates under the supervision and compliance requirements of:

- Controller of Certifying Authorities (CCA): Under the Ministry of Electronics and Information Technology (MeitY) – governs licensing and operational norms for DSC ecosystem
- Ministry of Electronics and Information Technology (MeitY): For digital governance and IT Act compliance
- Central Consumer Protection Authority (CCPA): Established under Consumer Protection Act, 2019 to regulate unfair trade practices and protect consumer rights
- Reserve Bank of India (RBI): Oversight of payment gateway partners and transaction security compliance
3.2 Compliance Standards
- All operations are conducted in compliance with applicable rules, orders, and guidelines issued by the above authorities
- Regular compliance audits and adherence to prescribed operational standards
- Maintenance of required licenses and certifications for intermediary services
4. User Responsibilities and Obligations
4.1 Information Accuracy
Users are required to:
- Provide complete, accurate, and truthful information during the application process
- Ensure all uploaded documents are genuine, valid, and belong to the applicant
- Update any changes in personal information promptly
- Verify the accuracy of all submitted details before final submission
4.2 Document Integrity
- All KYC documents must be authentic and unaltered
- Users must ensure documents are clearly legible and within validity periods
- Any falsification or misrepresentation of documents may result in immediate termination of services
4.3 Legal Compliance
- Users must comply with all applicable laws and regulations regarding DSC usage
- DSC misuse constitutes a criminal offense under the Information Technology Act, 2000
- Users are responsible for the secure handling and usage of their DSC once issued
- No unauthorized sharing or misuse of DSC credentials is permitted
4.4 Cooperation During Process
- Users must cooperate fully during the verification process
- Respond promptly to requests for additional documentation or clarification
- Be available for video verification calls when required by CAs
5. Pricing, Payments, and Refund Policy
5.1 Pricing Structure
- All prices are displayed in Indian Rupees (INR)
- Pricing may be inclusive or exclusive of applicable taxes (GST/other statutory taxes)
- Tax applicability will be clearly mentioned at the time of payment
- Prices are subject to change without prior notice, though existing transactions will be honored at agreed prices
5.2 Payment Terms
- Payment must be completed before processing of DSC application
- We accept payments through authorized payment gateways only
- All payment transactions are processed securely through RBI-compliant systems
- Payment confirmation is required for service initiation
5.3 Refund Policy
- Standard Refunds: Available within 7 calendar days of DSC issuance, subject to review and valid grounds
- Refund Conditions:
- DSC must be unused and in original condition
- Valid reason must be provided for refund request
- Refund processing may take 7-10 business days
- Non-Refundable Scenarios:
- Beyond the 7-day refund timeline
- User non-cooperation during the application process
- Rejection by CA due to user-provided incorrect information
- DSC revocation due to user misconduct
5.4 Re-issuance Charges
- Token locking or malfunction: INR 500 – INR 2,000 (depending on DSC type and CA requirements)
- Lost token replacement: As per CA charges plus service fee
- Additional charges may apply for expedited services
6. Intellectual Property Rights
6.1 Ownership
- All trademarks, service marks, logos, and content on this website are the exclusive property of ComplyQuick or its licensors
- Users are granted limited, non-exclusive access to use the website for intended purposes only
6.2 Restrictions
- No reproduction, redistribution, or commercial use of website content without written permission
- Users may not modify, adapt, or create derivative works based on our content
- Any unauthorized use may result in legal action and termination of services

- We do not guarantee DSC issuance – final approval is at the sole discretion of the respective Certifying Authority
- Our role is limited to facilitating the application process and providing intermediary services
- CA decisions are final and binding, and we have no authority to influence or overturn such decisions
7.2 Timeline Disclaimers
- Processing timelines are estimates based on normal circumstances
- Actual processing time depends on CA workload, document verification requirements, and user cooperation
- We are not liable for delays caused by CAs, technical issues, or external factors beyond our control
7.3 Technical Limitations
- We are not responsible for CA system downtime, technical glitches, or maintenance issues
- Users should have backup plans for urgent DSC requirements
- We provide support within our technical capabilities but cannot guarantee 100% uptime
8. Limitation of Liability
8.1 Financial Liability Cap
- Our total liability to any user is strictly limited to the amount paid by the user for our services
- This limitation applies regardless of the cause of action or theory of liability
8.2 Excluded Damages
We are not responsible for:
- Indirect, consequential, or punitive damages of any nature
- Loss of business, profits, or business opportunities
- Data loss or corruption not directly caused by our negligence
- Third-party actions or decisions (including CA decisions)
